Welcome to Saville Flowers & Gifts. These terms and conditions ("Terms") govern your use of our website and services. By accessing or using our website, purchasing our products, or engaging with our services, you agree to be bound by these Terms. Please read them carefully.

1. General Terms

1.1 Agreement: These Terms constitute a legally binding agreement between you and Saville Flowers.

1.2 Age Restriction: By accessing our website or purchasing our products, you confirm that you are of legal age in your jurisdiction or have obtained parental or guardian consent to use our website and services.

1.3 Modifications: We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to review the Terms periodically for updates.

2. Products and Services

2.1 Product Availability: Our products, including but not limited to fresh flowers, dried flowers, plants, vases, pots, candles, cards, and gifts, are subject to availability. We strive to accurately display product descriptions, pricing, and availability. In the event that a product is unavailable or out of stock, we will offer a suitable alternative of equal or greater value.

2.2 Pricing: Prices for our products and services are displayed on our website. We reserve the right to modify pricing without prior notice. Any changes will not affect orders already placed and paid for.

2.3 Delivery: We offer delivery services to Evanston, Chicago, and surrounding suburbs. We cannot guarantee delivery times, but do our best to accommodate special requests. We are not liable for delays or damages caused by third-party delivery services.

2.4 Substitutions: In the event that a specific flower or product is unavailable, we reserve the right to make substitutions of equal or greater value, while ensuring the overall aesthetic and style of the arrangement is maintained.

2.5 Care Instructions: We provide care instructions for fresh flowers on the back of our delivery tags. It is your responsibility to follow these instructions to ensure the longevity and freshness of the flowers. We have a 48 hour freshness guarantee. We are happy to share our detailed knowledge of plant care, however we cannot be liable for plants' viability 10 days after purchase.

3. Orders and Payments

3.1 Order Placement: To place an order, you must provide accurate and complete information. By placing an order, you authorize us to charge the provided payment method for the total order amount. Orders outside of Rogers Park, Lincolnwood, Evanston, Skokie, Wilmette, Winnetka, Northfield, and Glenview must be placed the day before. Same day delivery within our listed range can be accommodated until 1pm each day. Occasionally, deliveries can be made within 2 miles of the store until 3pm. 

3.2 Payment Methods: We accept payment by cash, credit/debit card and gift card vouchers. All payments are securely processed, and your financial information will be handled in accordance with applicable laws and regulations.

3.4 Order Cancellation: Order cancellations can only be accommodated if the request is made within a reasonable time frame before the scheduled delivery. Please call us at (847) 864-0632 for assistance in cancelling your order. If an order is cancelled after delivery is attempted, the delivery charge will still incur.

4. Returns and Refunds

4.1 Quality Concerns: We take pride in delivering unique, beautiful flowers, fresh potted plants, and high-quality products. If you are not satisfied with your purchase due to quality issues, please contact us within 48 hours of delivery and send photo evidence of your issue to bloom@savilleflowers.com. We will evaluate the situation and guarantee suitable resolution. Fresh flowers and plants may be subject to replacement. Hard and nonperishable goods such as pots, vases, candles, and decor may be returned within 14 business days with reciept as proof of purchase for an in-store credit towards a future purchase.

4.2 Refunds: Refunds, if approved, will be issued to the original payment method within 3-14 business days of purchase, subject to our payment processors and your bank's ability to receive return payments in a timely fashion. Refund amounts are subject to deductions for any discounts, promotions, or fees incurred during the transaction.

5. SMS Marketing

5.1 Consent: We periodically send out marketing promotions via SMS. By enrolling in our SMS text program you consent to receive SMS notifications about Saville Flowers & Gifts' products, services and marketing offers at the number provided. Message frequency may vary. Message and data rates may apply. Reply HELP for help and STOP to stop.

6.Intellectual Property

6.1 Ownership: All content, logos, images, designs, and other materials on our website are the intellectual property of saville Flowers & Gifts and are protected by applicable laws. You may not use, reproduce, modify, or distribute any of our intellectual property without prior written permission.

7. Limitation of Liability

7.1 Disclaimer: Our products and services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or suitability of our products, services, or content.

7.2 Limitation of Liability: In no event shall Saville Flowers & Gifts be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to our products, services, website, or these Terms, whether based on warranty, contract, tort, or any other legal theory.

8. Governing Law and Jurisdiction

8.1 These Terms shall be governed by and construed in accordance with the laws of the City of Evanston and the State of Illinois. Any dispute arising out of or relating to these Terms or your use of our products and services shall be subject to the exclusive jurisdiction of the courts of the City of Evanston and the State of Illinois.
